MEDICINE BOW NORDIC SKI PATROL
Ratified November 29, 1999

ARTICLE I – NAME The name of this organization shall be the Medicine Bow Nordic Ski Patrol. ARTICLE II – OBJECTIVES This organization is a non-profit unincorporated association. As such it shall serve the skiing public, the U.S. Forest Service, and the Albany County Sheriff's Department, State of Wyoming, by providing first aid, ski safety education, training, and search and rescue with standards set forth by the U.S. Forest Service and the Albany County Sheriff's Department. ARTICLE III – MEMBERSHIP Membership in the Medicine Bow Nordic Ski Patrol shall be in accordance with the Bylaws. ARTICLE IV – GOVERNMENT Government of the association shall be vested in the officers of the association in accordance with the Bylaws. The Medicine Bow Nordic Ski Patrol is a registration unit of the National Ski Patrol System Inc. As such, in the event that there is a conflict between (1) the Medicine Bow Nordic Ski Patrol Constitution, Bylaws, and associated Protocols and Procedures, and (2) the National Ski Patrol System Inc. Articles of Incorporation, Bylaws, and Policies and Procedures, the pertinent National Ski Patrol System, Inc. provision shall control. ARTICLE V – AMENDMENTS This constitution may be amended by a two-thirds majority of a quorum of the voting members at any meeting called in accordance with the Bylaws. ARTICLE VI – RATIFICATION Ratification of this Constitution shall follow the procedures established in Article V for the amendment.
 
 

BYLAWS

MEDICINE BOW NORDIC SKI PATROL
Ratified November 29, 1999

ARTICLE I – OFFICERS A. PATROL DIRECTOR
    1. The Patrol Director is the chief executive officer of the Medicine Bow Nordic Ski Patrol, and he/she shall be responsible for the operations of the patrol. The Patrol Director shall have the authority necessary for the performance of his/her duties, including negotiating an agreement with the U.S. Forest Service for the services to be provided by the Medicine Bow Nordic Ski Patrol. The Patrol Director shall be responsible for distributing a schedule of duty days to patrollers. The Patrol Director shall be a voting member of the organization.
    2. Election of the Patrol Director shall be in accordance with these Bylaws.
    3. The Patrol Director shall serve a term beginning the day following his/her election and continuing until the day following the duly scheduled election.
    4. The Patrol Director shall be eligible for reelection.
B. ASSISTANT PATROL DIRECTOR
    1. The Assistant Patrol Director shall be a voting member of the organization. The Assistant Patrol Director shall assist the Patrol Director in the operation of the organization. The Assistant Patrol Director, and his/her delegate, shall be responsible for organizing the yearly patroller refresher and testing program for new patrollers. Should the office of Patrol Director be vacated, the Assistant Patrol Director shall assume that office until such time that a Patrol Director is elected in accordance with these Bylaws.
    2. Election of the Assistant Patrol Director shall be in accordance with these Bylaws.
    3. The Assistant Patrol Director shall serve a term concurrent with the Patrol Director and shall be eligible for reelection.
C. SECRETARY/TREASURER
    1. The Secretary/Treasurer shall be a voting member of the organization. The duties of the Secretary/Treasurer are as follows:
      1. The Secretary/Treasurer shall prepare a proposed annual budget and an annual financial statement for the patrol. Said budget and financial statement shall be made public to all members of the patrol. He/she shall maintain patrol funds in an account separate from his/her own personal account and shall maintain such records, files and accounts as are necessary and surrender them to his/her successor upon expiration of his/her term.
      2. The Secretary/Treasurer shall keep a record of all the proceedings of the Medicine Bow Nordic Ski Patrol, keep the patrol membership roll, make the minutes and records available to any member upon request, and maintain record book(s) in which the constitution, bylaws, protocols, policies and procedures and minutes are entered, with any amendments to these documents recorded and have the current record on hand at every meeting.
    2. The Secretary/Treasurer shall be appointed by and serve at the pleasure of the Patrol Director, to serve a term to coincide with the term of the Patrol Director.


               D. FINANCE COMMITTEE

    1. The Finance Committee shall be the Patrol Director, Assistant Patrol Director, and the previously elected Patrol Director. In the event the previously elected Patrol Director is unable to serve, the Secretary/Treasurer shall serve.  The purpose of this committee is to insure that patrol funds are properly expended.
ARTICLE II – MEMBERSHIP
    1. Membership in the Medicine Bow Nordic Ski Patrol shall be of two categories, voting and general. A voting member must be currently registered with the National Ski Patrol System, Inc. as an active Nordic Basic, Nordic Senior, Auxiliary or Young Adult. The voting member must have the Medicine Bow Nordic Ski Patrol as his/her primary registration unit. A general member is a currently registered Associate, Inactive, Candidate or secondarily registered member. For voting purposes, each voting member shall have one vote regardless of the number of classifications a member may have.
    2. Classification of a member as a Nordic Basic, Nordic Senior, Auxiliary, Young Adult or Candidate shall be in accordance with National Ski Patrol policies. A member must meet all membership requirements of the National Ski Patrol System Inc.
    3. A member of the National Ski Patrol may transfer to the Medicine Bow Nordic Ski Patrol provided the said transferee is examined for proficiency and approved by the Patrol Director, Assistant Patrol Director, and two additional voting members designated by the Patrol Director.

ARTICLE III – COMMITTEES
    1. The Patrol Director shall appoint such committees as he/she deems necessary for the efficient operation of the patrol.

ARTICLE IV – MEETINGS
    1. The Medicine Bow Nordic Ski Patrol will hold a minimum of two patrol meetings per year. The annual meeting, to be held on or about April 30, is devoted to election of patrol officers. The second meeting is usually held in association with the Outdoor Emergency Care Refresher. Other meetings may be held as necessary to maintain the efficient operation of the patrol. The Patrol Director shall provide members with at least fourteen days notice of a meeting, including an agenda. Any member of the patrol may request a meeting by contacting the Patrol Director.
    2. Meetings shall be conducted in accordance with Roberts Rules of Order, Newly Revised 9th Edition.

ARTICLE V – ELECTIONS
    1. The elected officers of the organization, the Patrol Director and Assistant Patrol Director, shall be elected at a patrol meeting in accordance with Article IV of these Bylaws.
    2. The officers shall be elected by the voting members of the Medicine Bow Nordic Ski Patrol with more than half of a quorum (50%) of voting members present concurring.
    3. A voting member unable to attend the meeting may designate another voting member to exercise his/her written proxy, signed and dated by the absent member. The attending voting member shall notify the Patrol Director of the proxy prior to any vote.
    4. The Patrol Director may, at his/her discretion, appoint a nominating committee to prepare a slate of officers for consideration by the patrol. Preparation of such a slate shall not preclude nominations for any or all officers from the floor at the time of the election.
    5. Any or all officers may be removed from office, for failure to perform the duties of the office, at any patrol meeting, called in accordance with Article IV, via a vote by secret ballot with at least two-thirds of a quorum (50%) of the voting members concurring. Should both the Patrol Director and Assistant Patrol Director be removed from office, it shall be the responsibility of the Secretary/Treasurer to notify the next highest National Ski Patrol System Inc. line-of-authority of the removal from office and request their assistance in electing or appointing a new Patrol Director. The new Patrol Director shall then call a meeting to elect a new Assistant Patrol Director.

ARTICLE VI – AMENDMENTS
    1. These Bylaws may be amended by a two-thirds majority of a quorum of the voting members at any meeting called in accordance with Article IV. A quorum for the purpose of amending the Constitution, Bylaws, Elections and any other purpose shall consist of 50% of the voting members of the Medicine Bow Nordic Ski Patrol.

ARTICLE VII – POLICIES AND PROCEDURES
    1. The Polices and Procedures Manual of the Medicine Bow Nordic Ski Patrol shall follow in the operations of the patrol.
ARTICLE VIII – SEVERABILITY
    1. Should any provision of these Bylaws be determined to be invalid or unenforceable, such determination shall not affect any other provision, to the end that each provision be severable.
